1. Acceptance of Terms
Welcome to Cosmos Wallet. These Terms of Service (“Terms”) set the rules for how you may download, install, and use the Cosmos Wallet desktop application, website, and related services. By choosing to use the Wallet, you confirm that you have read and understood these Terms, and that you agree to be bound by them together with our Privacy Policy.
If you do not agree with any part of these Terms, you should not install or use Cosmos Wallet. These Terms apply to all users of the Wallet, including validators, token holders, developers, and community members.
The Wallet is provided as non-custodial software only. It does not create a financial services relationship between you and Cosmos Wallet developers, nor does it provide custody, investment advice, or guarantees of any kind. Your use of the Wallet is entirely at your own discretion and risk.
2. Description of Service
Cosmos Wallet is a desktop-based, non-custodial cryptocurrency wallet designed specifically for the Cosmos ecosystem. The Wallet allows users to create and manage accounts, hold tokens across multiple Cosmos chains, and interact with applications built on the Cosmos SDK and Inter-Blockchain Communication (IBC) protocol.
The Wallet does not hold funds on behalf of users. Instead, all private keys and signing approvals remain under the sole control of the user on their own device. Cosmos Wallet simply provides the tools for:
- Managing and transferring assets across supported Cosmos networks.
- Delegating tokens to validators and participating in staking rewards.
- Reviewing and voting on governance proposals.
- Connecting to decentralized applications that rely on Cosmos standards.
By design, Cosmos Wallet functions only as software. It is not a bank, exchange, or financial intermediary, and it cannot restore lost credentials or reverse blockchain transactions.
3. User Responsibilities
Using Cosmos Wallet means accepting full responsibility for how you manage your accounts and interact with the blockchain. Since the Wallet is non-custodial, no one but you can access or recover your funds. To ensure safe and lawful use, you agree to the following responsibilities:
3.1 Account Security
You are solely responsible for safeguarding your private keys, recovery phrases, and passwords. We strongly recommend keeping secure offline backups and avoiding storage on cloud services or shared devices. Any action taken with your keys will be considered authorized by you, even if it results from loss, theft, or compromise.
- Maintain updated operating systems and wallet versions.
- Use strong, unique passwords and device-level encryption.
- Keep recovery phrases offline in multiple secure locations.
3.2 Compliance
You agree to use Cosmos Wallet only in compliance with the laws and regulations of your jurisdiction. This includes, but is not limited to, financial regulations, anti-money laundering (AML) obligations, tax reporting rules, and international sanctions. It is your duty to understand how cryptocurrency regulations apply to you before using the Wallet.
- Ensure your use does not violate local or international sanctions.
- Verify whether you have reporting or licensing obligations.
- Consult independent legal or tax advisors if uncertain.
3.3 Prohibited Activities
You may not use Cosmos Wallet for unlawful purposes or in ways that could harm others. This includes creating or transmitting fraudulent transactions, funding prohibited organizations, violating intellectual property rights, or attempting to interfere with the security of the Wallet or Cosmos networks. Any use of the Wallet for cyberattacks, malware distribution, or unauthorized access attempts is strictly forbidden.
- Do not exploit bugs or vulnerabilities to gain unfair advantage.
- Avoid spamming networks with excessive or malicious transactions.
- Do not impersonate Cosmos Wallet or mislead users into sharing keys.
4. Risks and Disclaimers
Blockchain technology carries significant risks. By using Cosmos Wallet, you acknowledge and accept that interacting with decentralized networks involves factors outside our control. We provide the software “as is” and cannot guarantee outcomes of blockchain activity.
4.1 Market Risks
- The value of tokens and digital assets can fluctuate dramatically, sometimes within minutes.
- Past performance of assets does not indicate future results.
- Loss of value due to volatility is your sole responsibility.
4.2 Technical Risks
- Software may contain bugs or vulnerabilities that could affect performance.
- Unexpected failures, crashes, or incompatibility with your operating system may occur.
- Cosmos Wallet cannot guarantee uninterrupted availability of updates or integrations.
4.3 Network Risks
- Blockchains may experience downtime, congestion, or consensus failures.
- Transactions may be delayed, rejected, or result in higher-than-expected fees.
- Interoperability with third-party chains and dApps depends on their own reliability.
4.4 User Risks
- Losing your private keys or recovery phrase means permanent loss of access to funds.
- Mistakenly sending assets to the wrong address or chain cannot be reversed.
- Cosmos Wallet cannot retrieve lost funds, reset accounts, or undo transactions.
4.5 No Warranties
- The Wallet is provided “as is,” without warranties of merchantability, fitness for a purpose, or error-free performance.
- Use of the Wallet is at your own risk.
5. Limitation of Liability
Cosmos Wallet is provided as open-source, non-custodial software. While we strive for reliability and security, we cannot guarantee that the Wallet or connected networks will function without error or interruption. By using the Wallet, you agree that any risks of loss or damage remain entirely your own.
To the maximum extent permitted by law, Cosmos Wallet and its contributors will not be liable for:
- Loss of Funds: Any loss, theft, or mismanagement of digital assets resulting from lost keys, compromised devices, or mistaken transactions.
- Market Losses: Financial losses caused by price volatility, failed trades, or adverse market conditions.
- Software Issues: Damages arising from bugs, crashes, or incompatibility with your operating system.
- Network Failures: Delays, rejected transactions, or downtime due to blockchain congestion or validator outages.
- Third-Party Services: Risks associated with decentralized applications, exchanges, or relayers that integrate with the Wallet.
- Indirect or Consequential Damages: Including lost profits, lost business, or opportunity costs.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, but in all other cases, your sole remedy is to stop using the Wallet.
6. Privacy and Data Protection
Your privacy is a core principle of Cosmos Wallet. The Wallet is designed as non-custodial software, meaning your private keys and recovery phrases remain entirely under your control and never leave your device. However, some interactions with our website or support services may involve limited data collection, and we want to be transparent about how this is handled.
Integration with Privacy Policy Our Privacy Policy, incorporated into these Terms by reference, provides full details on what data may be collected, how it is stored, and how you may exercise your rights. By using the Wallet, you agree to the practices described there.
What We Do Not Collect We never request or store your private keys, seed phrases, account balances, or transaction history. On-chain activity occurs on public blockchains and is outside our control.
What We May Collect If you interact with our website, subscribe to updates, or contact support, we may collect limited personal data such as your email address or technical logs you choose to share. Such data is encrypted in transit (TLS/SSL) and stored securely with strict access controls.
User Rights You retain the right to access, correct, delete, or restrict processing of any personal data you voluntarily provide. Requests can be submitted via the contact details in Section 14.
Cosmos Wallet aims to minimize data collection wherever possible and aligns with global data protection standards such as the GDPR (EU) and CCPA (California), to the extent they apply.
7. Intellectual Property
Cosmos Wallet software is released as open-source and may be used, copied, or modified under the terms of its applicable license. Code contributions remain subject to that license, and users are encouraged to review it before redistribution or modification.
The name “Cosmos Wallet”, along with associated logos, design elements, and branding, are the property of the project maintainers and may not be used without prior written permission, except as permitted under fair use. You may not present modified versions of the Wallet as official, nor imply endorsement by the original developers without explicit consent.
All intellectual property rights not expressly granted remain reserved. Use of the Wallet does not transfer ownership of trademarks, logos, or other project assets.
8. Indemnification
You agree to defend, indemnify, and hold harmless Cosmos Wallet maintainers, contributors, and affiliated parties from claims, liabilities, and expenses that arise from your use of the Wallet or violation of these Terms.
This indemnification applies, without limitation, to:
- Use of the Wallet: Any losses or disputes resulting from your blockchain transactions, including mistaken transfers, network issues, or loss of access to your keys.
- Legal Compliance: Any failure to comply with laws, regulations, or sanctions applicable in your jurisdiction, including tax or reporting obligations.
- Third-Party Rights: Any claim that your use of the Wallet or connected services infringes upon intellectual property, contractual, or privacy rights of others.
- Misuse or Misrepresentation: Any attempt to use the Wallet in fraudulent, abusive, or deceptive ways, including impersonating the project or misleading others.
Indemnification obligations survive termination of these Terms. This means you remain responsible for covering costs or damages that result from your actions even after you stop using Cosmos Wallet.
9. Third-Party Services
Cosmos Wallet may enable connections to external services, such as validators, decentralized applications (dApps), relayers, and exchanges built within the Cosmos ecosystem. These integrations are provided solely for your convenience. We do not operate or control these services, and their availability or reliability is outside our control.
When you use any third-party service through the Wallet, you understand and agree that:
- You are subject to the terms, policies, and risks of that third party.
- We do not endorse, guarantee, or provide support for third-party platforms.
- Transactions with validators, DEXs, or other dApps are final and cannot be reversed by Cosmos Wallet.
- Any disputes, losses, or issues arising from third-party services must be resolved directly with the provider of that service.
10. Termination
Since Cosmos Wallet is distributed as open-source desktop software, you may continue to use the Wallet indefinitely on your device. However, we reserve the right to restrict or discontinue access to certain connected services at any time, with or without notice. This may include website features, update servers, support channels, or integration points maintained by the project team.
Termination may occur if you:
- Violate these Terms of Service or applicable laws.
- Misuse the Wallet in a way that harms the community, ecosystem, or networks.
- Attempt to compromise the security, integrity, or availability of our infrastructure.
In the event of termination, you retain full access to your locally stored wallet data and private keys. We cannot disable or seize your funds, but you may lose access to official support, updates, or integration services provided by Cosmos Wallet maintainers.
11. Dispute Resolution
We encourage users to resolve concerns informally, but recognize that disputes may arise. This section explains how such disputes will be handled.
Good-Faith Negotiations Both parties agree to attempt resolution through direct, good-faith discussions for a minimum of 30 days before pursuing arbitration or court proceedings.
Binding Arbitration If negotiations fail, disputes shall be resolved by binding arbitration under the rules of a recognized arbitration body, seated in Delaware, USA, conducted in English. Arbitration will be on an individual basis only; class or collective actions are not permitted.
Scope of Arbitration Arbitration covers any disputes arising out of these Terms, use of the Wallet, or connected services, except that either party may seek emergency injunctive relief or bring claims in small-claims court if eligible.
Costs and Awards Each party will bear its own arbitration costs unless the arbitrator determines otherwise. The arbitrator’s decision will be final and enforceable in any court with jurisdiction.
By accepting these Terms, you waive your right to trial by jury or to participate in a class action against Cosmos Wallet.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law provisions. This legal framework applies to all disputes arising from or relating to your use of the Wallet.
Jurisdiction Any disputes that proceed to court (rather than arbitration) will be subject to the exclusive jurisdiction of state or federal courts located in Delaware, USA.
International Users If you access Cosmos Wallet from outside the United States, you are solely responsible for ensuring your use complies with local laws. The availability of the Wallet in your country does not imply that it is legal or permitted under all local regulations.
Legal Consistency In the event of conflict between local regulations and these Terms, applicable mandatory local law will prevail, but the unenforceable provision will not affect the remainder of the Terms.
This Governing Law clause ensures legal predictability and provides a clear venue for dispute resolution, while also recognizing that users must comply with their own national laws.
13. Changes to Terms
We may update or revise these Terms of Service from time to time to reflect changes in technology, legal requirements, or the operation of Cosmos Wallet. Any modifications will take effect upon being posted on our official website or within the Wallet application.
Where changes are material, we will make reasonable efforts to notify users through announcements on the website, community channels, or other official communication methods. Continued use of the Wallet after updated Terms are posted will constitute your acceptance of the revised agreement.
We encourage you to review these Terms periodically. If you do not agree with the updated Terms, you must discontinue using Cosmos Wallet.
14. Miscellaneous
These Terms constitute the entire agreement between you and Cosmos Wallet regarding the Wallet.
- Severability: If any provision is unenforceable, the remainder stays in effect.
- No waiver: Our failure to enforce a provision isn’t a waiver of that right.
- Assignment: You may not assign these Terms without consent; we may assign as part of a reorganization.
- Force majeure: We aren’t liable for delays/failures beyond our reasonable control.
- Headings: For convenience only; they do not affect interpretation.
- Survival: Clauses on IP, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
